Welcome to Zaribari.com (“Website”), owned and operated by Zaribari, having its registered office at 46, Digvijay Path, Vasishta Marg, Vaishali Nagar, Jaipur, Rajasthan 302021, India (“Company”, “we”, “us”, or “our”).

By accessing or using our Website, or by completing a purchase transaction with us, you (“you”, “your”, or “user”) agree to be bound by the following Terms, Privacy, and Refund policies. Please read them carefully before making a purchase.

 

TERMS OF USE AND COMMERCIAL POLICY

1. ELIGIBILITY AND CAPACITY By using this Website and initiating a purchase, you legally confirm that you: (a) are at least 18 years of age ; (b) are of sound mind; and (c) are legally capable of entering into a valid and binding contract under the Indian Contract Act, 1872. Any transaction made by a person not fulfilling these criteria shall be considered void ab initio.   

2. USE OF WEBSITE You agree not to:

  • Misuse the Website or engage in any fraudulent, unethical, or illegal activity;
  • Copy, reproduce, modify, or use Website content for direct or indirect commercial gain without the express written consent of ZARIBARI;
  • Interfere with the security mechanisms, functionality, or digital integrity of the Website or its supporting infrastructure.

3. PRODUCTS, NATURE OF GOODS, AND AVAILABILITY All products displayed are custom-made, handcrafted, and designer-specific. You acknowledge and accept that: (a) The unique, manual nature of the garments means that slight variations in color, embroidery, texture, or finish are inherent characteristics and shall not be treated as manufacturing defects or deficiencies in quality. (b) Specifications, sizing, and color representations provided by the consumer are final upon order placement. Prices and product availability are subject to change without prior notice.   

4. ORDERS, CONTRACT FORMATION, AND ACCEPTANCE Your act of placing an order constitutes an offer to purchase the specified goods. The contract between you and ZARIBARI becomes legally binding only at the moment we explicitly confirm the order acceptance via email or upon the physical dispatch of the product, whichever occurs first. We reserve the unqualified right to cancel or refuse any order at our sole discretion prior to dispatch (e.g., stock unavailability, material changes in cost/pricing errors, payment failure, or suspected fraudulent activity), without incurring any liability towards you beyond a full refund of the amount paid.   

5. PRICING AND PAYMENT METHODS All prices displayed are in Indian Rupees (INR) and represent the total final price, including the breakup of the cost of the good or service, and all compulsory charges and applicable taxes, as mandated by the Consumer Protection (E-Commerce) Rules, 2020. Digital Payments Only: We accept only prepaid digital payments (UPI, net banking, debit/credit cards, wallets). Cash on Delivery (COD) is not available. This decision is a justifiable commercial practice due to the bespoke, high-value, and custom-made nature of the goods, which requires significant resource commitment prior to dispatch. In the event of a technical error (pricing or payment), we may cancel the order and process a full refund without further compensation.   

6. SHIPPING AND DELIVERY We deliver across India using trusted logistics partners. Delivery timelines displayed at checkout are estimates only. ZARIBARI is not liable for service deficiencies or delays caused by the courier service, customs, or events of force majeure (events beyond our reasonable control). Risk Transfer: The risk of loss, damage, or theft of the product passes from ZARIBARI to you immediately upon successful delivery of the order to the address specified, as verified by the courier's proof of delivery. You are responsible for inspecting the package for physical damage upon receipt.

 

7. RETURN, REFUND & CANCELLATION POLICY (STATUTORY COMPLIANCE)

7.1 Strict No Return / No Exchange Policy for Subjective Issues Given that Zaribari garments are custom-made, handcrafted, and often personalized based on consumer specifications, all sales are final, and we enforce a strict No Return and No Exchange Policy for the following reasons : (a) Change of Mind or Subjective Dissatisfaction: Where the consumer no longer wants the item. (b) Sizing or Fit Issues: Where the issue arises from inaccurate measurements provided by the consumer or subjective fit preferences not related to manufacturing failure. This general policy is absolute, except where superseded by the mandatory statutory rights specified in Clause 7.3.   

7.2 Order Cancellations Cancellations may only be requested within 24 hours of placement, and only if the production or procurement process has not been initiated. Commencement of production voids the right to cancel. For approved cancellations, the refund will be processed within 7–10 business days to the original payment source, after the deduction of actual and irreversible third-party costs incurred (such as non-refundable payment gateway transaction fees). These deductions are directly proportionate to the loss suffered by the Company and do not constitute an arbitrary penalty or an "unfair contract" term.   

7.3 Right to Remedy for Statutory Defects (Mandatory Law) Notwithstanding Clause 7.1, the Company cannot refuse to take back goods, or refuse a refund, if the product is found to be defective, deficient, spurious, or materially different from the representation or advertisement on the Website, as per the Consumer Protection Act, 2019.   

  • Reporting & Burden of Proof: If your product is damaged, incorrect, or defective, you must contact infozaribari@gmail.com within 24 hours of delivery. The consumer is required to provide comprehensive evidence (photos/videos) clearly demonstrating an inherent manufacturing defect. The consumer bears the initial burden of establishing the existence of a defect and cannot rely solely on subjective claim.   
  • Remedy Choice: If the statutory defect or deficiency is verified and confirmed by ZARIBARI, the consumer shall have the statutory right to choose their remedy from the following options :   
    • Replacement with the same or equivalent product (if available); OR
    • Repair or Alteration of the verified defect; OR
    • Full Monetary Refund (to the original payment source).

7.4 International Orders All international sales are final. The customer is solely responsible for all import duties, customs charges, and liabilities for delays in destination countries.

7.5 Complaint Tracking ZARIBARI is committed to providing timely resolution. For all consumer complaints lodged regarding order issues or statutory defects, the Company will assign and communicate a ticket number through which the consumer can track the status of their complaint.   

 

8. INTELLECTUAL PROPERTY

All intellectual property, including designs, images, product photographs, source code, and brand marks on the Website, are the exclusive property of ZARIBARI. Unauthorized reproduction, distribution, public display, or use for commercial purposes is strictly prohibited and constitutes an infringement of the Company's proprietary rights.

9. LIMITATION OF LIABILITY To the maximum extent permissible under the law, ZARIBARI's total cumulative liability for any claim arising from the use of the Website or products shall be strictly limited to the purchase price paid for the specific product giving rise to the claim. ZARIBARI shall not be liable for the following losses, which are expressly excluded: (a) Indirect, incidental, or consequential losses ; (b) Any commercial or economic loss, including loss of profit or revenue ; (c) Harm caused to the product itself, or damage to property on account of a breach of warranty conditions (as defined by the CPA 2019).   

Nothing in these Terms affects your statutory consumer rights under Indian law. This clause only limits liability for losses not covered under the mandatory product liability provisions of the Consumer Protection Act, 2019 (CPA 2019), which mandates compensation for personal injury, illness, death, or damage to property (other than the product itself) caused by a defective product.   

 

10. PRIVACY POLICY AND DATA SECURITY

10.1 Information We Collect We collect Personal Information, including:

  • Name, phone number, email, and address for essential order fulfillment;
  • Financial Information: Payment and transaction data (processed securely by third-party payment gateways), which is classified as Sensitive Personal Data or Information (SPDI) under the IT Act, 2000 ;   
  • Technical Data: Device, IP, and browser information for analytics and security.

10.2 Lawful Use of Information Your information is processed for the lawful purpose of:

  • Processing orders and payments;
  • Communicating essential service and product updates;
  • Complying with mandatory legal or regulatory obligations.

10.3 Data Security and Compliance We implement and maintain Reasonable Security Practices and Procedures (RSPP), in compliance with the Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011, for the protection of all SPDI under our control. We utilize industry-standard safeguards to prevent unauthorized access or disclosure. However, due to the inherent risks of internet transmission, we cannot guarantee absolute security.   

10.4 Data Sharing We do not sell, trade, or rent your personal data to third parties. We share it only with:

  • Essential Processors: Payment processors and logistics partners for the sole purpose of order completion;
  • Legal Authorities: Government or regulatory authorities when legally required.

10.5 Data Retention and DPDP Act Readiness We retain personal data only for the duration required to fulfill the specified business purpose, or as mandated by law (e.g., tax records). We are proactively monitoring the coming into effect of the Digital Personal Data Protection Act, 2023, and commit to ensuring our data handling processes comply with future standards for consent and data protection.

11. GOVERNING LAW AND JURISDICTION These Terms and Policies are governed by and construed in accordance with the laws of India. Exclusive Jurisdiction: All non-consumer related contractual disputes shall be subject to the exclusive jurisdiction of the competent courts at Sikar/Jaipur, Rajasthan, India. Consumer Forums: This exclusive jurisdiction clause does not, and legally cannot, restrict a consumer's statutory right to file a complaint before the competent Consumer Disputes Redressal Commissions located in their area of residence, where the cause of action arose, or where ZARIBARI has a branch office.   

12. AMENDMENTS We may revise these Terms and Policies periodically. Updates will be posted on this page with the new effective date. Your continued use of the Website after such updates constitutes acceptance of the revised terms.

14. ENTIRE AGREEMENT This single document constitutes the full and entire agreement encompassing the Terms, Privacy Policy, and Return/Refund Policy governing your use of Zaribari.com and supersedes all prior communications, representations, or agreements, written or oral.
